asks Florida court to reject habeas corpus relief
for two of Cuban Five
December 6, 2011, the U.S. government asked the
Southern District of Florida Court to reject the
collateral petitions for habeas corpus relief filed
by Ramón Labañino and Fernando González, alleging
that the arguments put forward lack the legal merit
to be considered by the court.
In its response presented to the court, the
government stated that the argument in both
petitions concerning payments made by the U.S.
administration to Miami journalists before and
during the trial of the Five to create a climate of
hostility against them and prejudice the jury does
not constitute a violation of due process. The
response also objects to the other arguments in the
petitions and asked the judge to discount them.
The government motion is in response to the
petitions for habeas corpus relief filed by the
defense lawyers of Ramón Labañino and Fernando
González on August 8 and September 12, 2011,
respectively. It is now the turn of the defense to
present a response to the motion, which should occur
early next year and which will conclude the
documentation process of the habeas corpus request
before the court. It then remains for the judge to
make her decision, for which there is no specific
time limit. (www.antiterroristas.cu) •
